DVC Exercises Right of First Refusal (ROFR)
Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 86 Disney Vacation Club (DVC) contract, and DVC Resale Market (DVCRM) has sold 2,325, resulting in a 3.7% buyback rate (Contracts Bought Back in 2026/Contracts Sold in 2026). The 2026 waiver rate is 96.3%.
Key ROFR Updates
July has come and gone, and I’m beginning to wonder where the summer went. In the world of Right of First Refusal, though, things have come full circle, with Old Key West reclaiming its place as Disney’s most active buyback resort of 2026.
Old Key West added seven buybacks in July, bringing its year-to-date total to 24 contracts. That equates to a 12.4% buyback rate, or roughly one out of every eight contracts sold through DVC Resale Market being purchased back by Disney this year. While that’s certainly one of the highest rates we’re seeing, it’s still a reminder that the overwhelming majority of contracts continue to pass ROFR without issue.
Grand Californian Continues to Lead by Percentage
Although Old Key West now leads in total buybacks, Disney’s Grand Californian Hotel & Spa continues to be the clear leader when looking strictly at buyback percentage.
Three additional Grand Californian contracts were bought back in July, bringing the resort to nine buybacks on the year and a 17.3% buyback rate. That’s nearly one in every five Grand Californian contracts being purchased by Disney, making it the resort where buyers are currently most likely to encounter ROFR.
Given the resort’s limited inventory, high direct value, and continued demand at Disneyland Resort, those numbers aren’t especially surprising.
Another Massive Disneyland Hotel Buyback
If the Disneyland Hotel Villas caught your eye in this month’s report, the story is almost identical to what we saw in June.
Disney once again exercised ROFR on a 1,500-point Disneyland Hotel contract priced at $105 per point. When you’re talking about a contract with a purchase price of approximately $157,500, it’s easy to understand why Disney stepped in. Large point blocks like these are incredibly valuable inventory that Disney can easily resell through its direct sales program at a substantially higher price per point.
Sometimes it’s fun to look beyond the percentages and remember that these buybacks represent real dollars. In this case, Disney wrote a check for well over $150,000 for a single contract—and will almost certainly have no trouble turning those points into considerably more revenue through direct sales.
The Bigger Picture
Looking across the market as a whole, not much has changed from the broader trend we’ve watched throughout 2026. The overall buyback rate sits at just 3.7%, meaning the waiver rate remains an impressive 96.3%.
Grand Californian and Old Key West continue to be the primary ROFR stories this year, while Grand Floridian remains active with 22 buybacks despite its percentage gradually easing to 12.9% as more contracts continue to sell.
For everyone else? ROFR remains exactly what I’ve been saying for months: it’s a step in the buying process, not something to lose sleep over. Disney is clearly being selective with where it exercises its rights, and for the vast majority of buyers, the odds continue to be overwhelmingly in your favor.
What is Right of First Refusal (ROFR)?
For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.
DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.

The table below lists the percentage of buybacks for resorts that have had at least one contract repurchased in 2026, along with the number of contracts bought back for each specific resort this month. Note, there have been no buybacks of the following resorts in 2026: Boardwalk, Copper Creek, Vero Beach, Polynesian, and Fort Wilderness.
