DVC Right of First Refusal Report (ROFR): October 2026

Old Key West - Olivia's Cafe

DVC Exercises Right of First Refusal (ROFR)

Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 116 Disney Vacation Club (DVC) contract, and DVC Resale Market (DVCRM) has sold 3,164, resulting in a 3.7% buyback rate (Contracts Bought Back in 2026/Contracts Sold in 2026). The 2026 waiver rate is 96.3%.

Key ROFR Updates

October looked a lot like September when it came to ROFR activity, with nine contracts bought back across five resorts. We did see a few one-offs pop up at places like Bay Lake Tower and Riviera, but the main story continues to be Old Key West, where Disney bought back another five contracts this month. That brings Old Key West to 32 buybacks for the year and a 12.7% buyback rate, the highest total number of buybacks of any resort in 2026.

Overall, though, not much changed. Disney has now exercised ROFR on 116 contracts sold through DVC Resale Market this year, keeping the overall buyback rate right where it was last month at 3.7%. That 3% to 4% range has really been the story for most of 2026, with Disney remaining selective rather than aggressively buying across the board.

As we head into the holiday season, I also wouldn’t let ROFR scare you away from a resale purchase. If a DVC contract happens to be on someone’s Christmas list this year, now is probably the time to start making that decision. With more than 96% of contracts continuing to pass ROFR, the odds remain overwhelmingly in the buyer’s favor, even if Old Key West continues to be the resort where Disney seems most interested in crashing the party.

I wish I had something more dramatic to report this month, but at this point I’m being distracted by twinkling Christmas lights and thinking about which Disney Vacation Club ornaments need to go on the tree. So unless Disney decides to make November considerably more exciting, I’m going to go do that instead. Here’s hoping they give me a little more to talk about next month!

What is Right of First Refusal (ROFR)?

For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.

DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.
