DVC Exercises Right of First Refusal (ROFR)

Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 98 Disney Vacation Club (DVC) contract, and DVC Resale Market (DVCRM) has sold 2,664, resulting in a 3.7% buyback rate (Contracts Bought Back in 2026/Contracts Sold in 2026). The 2026 waiver rate is 96.3%.

Key ROFR Updates

August brought one of the more interesting ROFR reports of 2026—not necessarily because Disney bought back a huge number of contracts, but because of how widely that activity was spread across the DVC portfolio.

Disney exercised ROFR on 12 contracts across nine different resorts in August.

The resorts leading the pack weren’t much of a surprise. Grand Californian and Grand Floridian each saw two buybacks, continuing trends we’ve watched throughout 2026. Grand Californian now has the highest buyback percentage of any resort at 18.6%, while Grand Floridian sits at 12.8%. Old Key West remains the volume leader with 25 contracts bought back year-to-date and an 11.8% buyback rate.

What caught my attention this month was the variety. Nine different resorts had at least one contract bought back, including some relatively uncommon ROFR targets like Bay Lake Tower, Beach Club, Boulder Ridge, Hilton Head, and Aulani. We’ve occasionally seen this type of broader activity as we approach the end of Disney’s fiscal year or later in the calendar year. Part of me always wonders if Disney uses some of these one-off purchases to get additional inventory, or even another data point at resorts they haven’t been particularly active with.

The Aulani Buyback Is Particularly Interesting

The best example this month is Aulani.

Disney bought back a subsidized Aulani contract at $85 per point with more than 1,200 points available. That’s a very large contract and certainly not an insignificant purchase for Disney, but there is another wrinkle that makes this one especially interesting.

Because it was a subsidized contract, Disney has the opportunity through the buyback and eventual resale process to return those points to its inventory without carrying forward that legacy subsidized dues structure. Given the unusual nature of subsidized Aulani contracts, that makes this particular ROFR much easier to understand than simply looking at the $85-per-point purchase price. The report shows that $85 was also well below Aulani’s rolling-year ROFR high of $101 per point.

Ultimately, I don’t think August changes the broader ROFR story we’ve been following throughout 2026. More than 96% of contracts sold through DVC Resale Market have still passed ROFR this year. The interesting part this month isn’t an overall increase in risk, it’s Disney spreading its buybacks across a much wider variety of resorts.

As we head into September and the end of Disney’s fiscal year, I’ll be particularly interested to see whether this broader buying pattern continues or August ultimately proves to be a collection of opportunistic one-offs.


What is Right of First Refusal (ROFR)?

For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.

DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.

The table below lists the percentage of buybacks for resorts that have had at least one contract repurchased in 2026, along with the number of contracts bought back for each specific resort this month. Note, there have been no buybacks of the following resorts in 2026: BoardwalkCopper Creek, Vero Beach, Polynesian, and Fort Wilderness.
