DVC Exercises Right of First Refusal (ROFR)

Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 107 Disney Vacation Club (DVC) contract, and DVC Resale Market (DVCRM) has sold 2,895, resulting in a 3.7% buyback rate (Contracts Bought Back in 2026/Contracts Sold in 2026). The 2026 waiver rate is 96.3%.

Key ROFR Updates

September marked the second-slowest month of 2026 for ROFR activity, with just nine contracts bought back across five different resorts. That also lines up with the seasonal slowdown we usually start to see in resale activity as we head into the fall, so I don’t think there’s anything too dramatic to read into there.

The biggest thing that caught my attention this month was Vero Beach, which finally joined the 2026 buyback list with three contracts reclaimed in September. All three were smaller 50-point contracts, with the highest buyback price reaching $63 per point. To me, those looked like pretty appealing contracts for Disney to grab. Maybe they had someone looking to buy Vero Beach direct and needed to pull some points back into inventory?

Of course, the conspiracy-theory side of me always gets interested around this time of year because Disney does seem to occasionally start picking off some random contracts at resorts we haven’t seen much ROFR activity from. Part of me likes to think they’re just gathering a little extra resale-market data before year-end. So if I’m sitting here next month talking about a random Copper Creek or Polynesian buyback, I’ll go ahead and say hello now to all the Disney Vacation Club people reading this report and taking notes.

Other than that, the ROFR story really hasn’t changed much in 2026. Disney is still being very selective, with more than 96% of DVC Resale Market contracts passing ROFR, and most of the activity remains concentrated at a relatively small group of resorts. We’ll see if September’s broader mix of buybacks turns into anything more interesting as we move through the final few months of the year.


What is Right of First Refusal (ROFR)?

For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.

DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.

The table below lists the percentage of buybacks for resorts that have had at least one contract repurchased in 2026, along with the number of contracts bought back for each specific resort this month. Note, there have been no buybacks of the following resorts in 2026: Boardwalk, Copper Creek, Polynesian, and Fort Wilderness.
