DVC Exercises Right of First Refusal (ROFR)

Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 108 Disney Vacation Club (DVC) contracts, and DVC Resale Market (DVCRM) has sold 857, resulting in a 12.6% buyback rate (Contracts Bought Back in 2022/Contracts Sold in 2022). The 2022 waiver rate is 87.4%.

Key ROFR Updates

In what has now become known as the BoardWalk and Beach Club “Blood Bath” of 2022 on social media, these two resorts continued to see extremely high ROFR buybacks in February.  Combined, these resorts total 38% of all Disney Vacation Club buybacks so far on the year.

Think this might be a seasonal occurrence?  In comparing data to February 2021, Beach Club saw no buybacks in a similar timeframe while BoardWalk had 18 ROFR’d in the first two months of 2021.  Buyers at these two resorts will need to be patient and listen to their sales associates when it comes to making an offer to hopefully avoid the dreaded ROFR email.

Disney’s ROFR efforts for 2022 also remain strong when it comes to DVC Resorts set to expire in 2042.  These resorts account for 62% of all contract buybacks year-to-date, with Beach Club seeing an all-new record buyback price-per-point at $172.

In the first familiar thing to report this month, Saratoga Springs has rebounded from an abnormally slow buyback month in January 2022.  Saratoga led all buybacks in February, with 15 contracts purchased by DVC this month, and is now tied for the most buybacks on the year.

What is Right of First Refusal (ROFR)?

For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.

DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.

Note, there have been no buybacks of the following resorts in 2022 thus far: Aulani, Grand Californian, Riviera Resort, Grand Floridian, Polynesian, and Hilton Head.
