DVC Exercises Right of First Refusal (ROFR)
Year-to-date (YTD) through October 2021, Disney has exercised their right of first refusal (ROFR) on 437 Disney Vacation Club (DVC) contracts. DVC Resale Market (DVCRM) has sold 3,754, resulting in an 11.6% buyback rate (Contracts Bought Back in 2021/Contracts Sold in 2021). The 2021 waiver rate is 88.4%.
Key ROFR Updates
- On the year, DVCRM has seen a 59% increase in buybacks, surpassing 2020 by over 163 contracts thus far. Leading the way are Old Key West (112), Saratoga Springs (94), Bay Lake Tower (55), and Animal Kingdom (88), totaling 81% of contracts bought back in 2021.
- Joining the list of buybacks this month were Beach Club and Boulder Ridge, which both saw their first contracts taken for this calendar year.
- Copper Creek (20) doubled its total number of contracts taken on the year, and yet again set a new price per point buyback record in October at $170 per point.
- Speaking of highest prices, Disney has shown a significant increase in the price at which it is willing to exercise its ROFR this year. For example, Animal Kingdom’s highest buyback price is 44% higher than it was a year ago, and Saratoga Springs and Old Key West have also seen their highest ROFR rates rise by 27% and 32% respectively.
What is Right of First Refusal (ROFR)?
For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.
DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.

I just bought 50 pts @ SSR for $135. I thought for sure that Disney was going to snag it, but they didn’t. So excited, now just waiting to hear back from Disney with our account info.
