DVC Exercises Right of First Refusal (ROFR)

Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 138 Disney Vacation Club (DVC) contract, and DVC Resale Market (DVCRM) has sold 3,568, resulting in a 3.9% buyback rate (Contracts Bought Back in 2025/Contracts Sold in 2025). The 2025 waiver rate is 96.1%.

Disney Tightens the Pricing Belt

If July felt like a ROFR shake-up, August confirmed it’s not a one-month fluke.

This month brought 22 buybacks across 9 different DVC resorts, continuing the exact trend we saw in July. And while the number is slightly lower than last month’s 26, the consistency is telling – ROFR is back, and Disney seems to be using it more strategically.

It’s becoming clearer that DVC is leaning into ROFR the way it was likely always intended: as a mechanism to help stabilize pricing and keep the resale market from drifting too far below direct pricing. And nowhere is that more evident than with the first-ever Riviera buyback we reported on earlier this month.

That Riviera contract? Taken back at $89 per point. When you consider direct pricing is currently $235/pt, Disney potentially made nearly $50,000 just flipping that one. That’s not just smart business – it’s probably the easiest margin they’ve seen all year.


A Trend Toward “Too Good to Be True”?

There were a few other buybacks this month that raised similar eyebrows:

These aren’t just slightly below average – they’re aggressively low, and clearly crossed the threshold where Disney decided to act. So the message here might be: if the price seems too good to be true, it might just be irresistible to the ROFR Monster.


Looking Ahead: Will September Bring a Fiscal Year-End Bump?

With September marking the end of Disney’s fiscal year, I’ll be watching closely to see if we see one last surge in buybacks. It’s not uncommon for companies to firm up inventory or spending before the books close.

That said, while this all feels like an increase in activity (and it is!), let’s keep perspective: less than 4% of contracts sold this year have been bought back. So while ROFR is certainly something to monitor, it’s still rare unless you’re getting a screaming deal.


What is Right of First Refusal (ROFR)?

For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.

DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.
