DVC Exercises Right of First Refusal (ROFR)

Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 116 Disney Vacation Club (DVC) contract, and DVC Resale Market (DVCRM) has sold 3,060, resulting in a 3.8% buyback rate (Contracts Bought Back in 2025/Contracts Sold in 2025). The 2025 waiver rate is 96.2%.

Key ROFR Updates

I’m never complaining again about a “quiet” ROFR month.

Because let me tell you—after spending two hours reworking all our ROFR graphs and charts thanks to July 2025’s chaos, I hereby declare this “The Great ROFR Reset.”

This month, we saw the highest number of buybacks year-to-date, with 26 contracts taken back across nine different resorts. Yep, you read that right… NINE resorts! That’s not just activity, that’s an all-out reshuffling of what we thought we knew about Right of First Refusal this year.

Six resorts experienced their first buybacks in quite some time: Beach Club, Boardwalk, Boulder Ridge, Copper Creek, Saratoga Springs, and Vero Beach. That means that, within a rolling 12-month window, only five DVC resorts have not had a single contract taken back via ROFR: Bay Lake Tower, Riviera, Fort Wilderness, Disneyland Hotel, and Hilton Head. Pretty wild shift from just a month ago.

So what does this all mean?

Look, I doubt Disney Vacation Club just found a pile of cash and said, “Hey, let’s stir things up and give Paul a headache.” (Although that’s what I like to imagine in my more cynical moments.)

My best read? This was a strategic reset. With resale prices dropping and the gap between direct and resale growing wider, I think DVC saw some deals they couldn’t ignore and took action to apply a bit of pressure back into the market.

Let’s take Copper Creek for example. Disney scooped up a contract at $118 per point, while the average resale price for June 2025 was $136 (a 13% discount). That’s a prime candidate for a buyback if you’re trying to keep valuations from sliding too far.

Then there’s Vero Beach! Yes, even Vero Beach got a buyback. One contract at just $37 per point, which is astounding when you consider it’s well below the historical floor for any DVC property.

Not every buyback was below average though. Beach Club’s lone ROFR’d contract was a 350-point deal at $139 per point, which was actually above June’s average of $136. So this isn’t just bargain hunting, it looks more like strategic balancing.

The Big Mover

If there’s a “winner” this month in terms of volume, it’s Old Key West. DVC took back 15 contracts this month alone, ranging from $64 to $87 per point. That matches the total number of buybacks for Old Key West for the entire year, before July even started. Clearly, OKW’s combination of low prices and option to extend continues to make it attractive for Disney.

Wrapping It Up

This month was a ROFR wake-up call. Whether it’s a short-term blip or the start of a new trend, it’s too soon to say. But it definitely reminds us that DVC is watching the market closely, and willing to act when they see value. For buyers, it means you’ll want to stay alert. For sellers, pricing smart is more important than ever.

And for me? I at least know the charts can’t get any worse to update this year, right?


What is Right of First Refusal (ROFR)?

For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.

DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.
