Year-to-date, Disney has exercised their right of first refusal (ROFR) on 131 Disney Vacation Club (DVC) contracts, and DVC Resale Market has sold 828, resulting in a 15.8% buy back rate. (Contracts Bought Back in year-to-date / Contracts Sold year to date). The year-to-date waiver rate is 84.2%.

February 2019 became the highest month ever observed for buy backs with 82. This high volume is due not only to higher increases in buy back rates being observed, 9.2% and 10.5% buy back rates in 2017 and 2018 respectively, compared to 15.8% in 2019, but also a very high volume of sales in 2019, 828 through in just two months. A large spike in sales for January was observed with buyers purchasing prior to resale changes that became effective on January 19th. It is important to note, that post the resale change of January 19th, the sales pace is much stronger than prior year also.

Chances of passing ROFR is highly resort-dependent. For instance, Animal Kingdom, Bay Lake Tower, Beach Club, Hilton Head and Saratoga Springs all have buy back rates of 20% or higher in 2019, while we haven’t observed a buy back of Aulani contract in several years.

The chart below shows the relationship between the average selling price per point and the buy back rate from February 2018 through February 2019. Historically, we have observed resale price per point and buy back rate have an inverse relationship.

What is Right of First Refusal (ROFR)?

For those new to the concept of Right of First Refusal, it is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.

DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the Seller and original Buyer. DVC then becomes the Buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.

Year-to-date, 8 different DVC resorts experienced buy backs (in order of buy back volume): Bay Lake Tower, Animal Kingdom, Saratoga Springs, Beach Club, Boardwalk, Grand Floridian, Hilton Head and Old Key West.
