DVC Exercises Right of First Refusal (ROFR)
Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 647 Disney Vacation Club (DVC) contracts, and DVC Resale Market (DVCRM) has sold 2,684, resulting in a 24.1% buyback rate (Contracts Bought Back in 2022/Contracts Sold in 2022). The 2022 waiver rate is 75.9%.
Key ROFR Updates
With the first half of 2022 now behind us, gone are the thoughts that Disney’s Right of First Refusal (ROFR) efforts will be slowing down any time soon. We’ve entered a new normal now when it comes to buybacks, and buyers are beginning to accept the age-old adage, “If At First You Don’t Succeed, Try, Try Again”.
June 2022 saw us eclipse the total number of ROFR’d contracts for the entire year 2021 (579), adding 164 more contracts to the list that now totals 647. I guess the only real question now is whether we will top 1,000 buybacks this year?
An interesting emerging trend may give buyers great opportunities when purchasing certain Disney Vacation Club Resorts. Disney specifically targeted six properties with buybacks during Q2 2022: Saratoga Springs, Animal Kingdom, Bay Lake Tower, Old Key West, BoardWalk, and Copper Creek. Buyers tired of playing the ROFR game should turn their eye to properties that Disney is not actively paying attention to.
Aulani, Polynesian, and Grand Floridian are three resorts that are basically a safe bet when it comes to passing ROFR. Disney historically has not bought back actively selling properties making these some excellent opportunities for buyers.
What is Right of First Refusal (ROFR)?
For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.
DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.
