DVC Right of First Refusal Report (ROFR): September ’22

DVC Exercises Right of First Refusal (ROFR)
Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 1,047 Disney Vacation Club (DVC) contracts, and DVC Resale Market (DVCRM) has sold 3,775, resulting in a 27.7% buyback rate (Contracts Bought Back in 2022/Contracts Sold in 2022). The 2022 waiver rate is 72.3%.
Key ROFR Updates
September is always an interesting month when observing Disney’s ROFR trends, as it marks the end of its fiscal year. Speaking generally, that means: Spend the money, or it disappears!
While overall buybacks were down for the month, several noticeable trends have emerged as we head into Disney’s 2023 budget.
This month saw the continuation of a trend we noted in our August 2022 ROFR report, with the attention turning away from Old Key West and Saratoga Springs and onto Bay Lake Tower, Animal Kingdom, and Copper Creek.
Animal Kingdom took over the second-highest buyback spot with 199 contracts sold by DVC Resale Market ROFR’d by Disney. This has resulted in a 45.5% buyback rate for this extremely popular resort this year.
Lastly, Bay Lake Tower hit a new highest monthly buyback price per point in September. Disney elected to take a small 50-point contract for the resort at $188 per point.

What is Right of First Refusal (ROFR)?
For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.
DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.
