DVC Exercises Right of First Refusal (ROFR)

Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 160 Disney Vacation Club (DVC) contract, and DVC Resale Market (DVCRM) has sold 3,860, resulting in a 4.1% buyback rate (Contracts Bought Back in 2025/Contracts Sold in 2025). The 2025 waiver rate is 95.9%.

Key ROFR Updates

Well, if you were wondering whether Disney was going to spend its remaining ROFR budget before the fiscal year ended… let me tell you—they absolutely did. And not a moment too soon.

We were getting last-minute ROFR notifications as late as 8 PM on September 30th. That’s right—literal end-of-fiscal-year scrambling. And with that, the books are (presumably) closed on Disney’s ROFR activity for its FY25.


Same Number, Different Impact

September matched August’s total with 22 buybacks, but here’s the interesting part—because of lower overall contract volume this month, the buyback rate actually ticked up by 3.2%. That’s a decent jump in percentage terms and a reminder that even steady numbers can have shifting context depending on the season.

What Didn’t Get Bought Back

Polynesian. Nothing. Nada. Zilch.

It’s now officially been over a year since we’ve seen a single Polynesian contract taken via ROFR. The last one occurred just before direct sales of the Polynesian Island Tower began. Since then? Crickets.

At this point, I think it’s safe to say Polynesian resale is like rhubarb to the ROFR Monster—just no appetite for it.

Also still untouched in 2025: Bay Lake Tower, Disneyland Hotel, Fort Wilderness, and Hilton Head—all with a big fat zero in the buyback column.


Final Thought

While the volume wasn’t shocking, the timing was. The fact that Disney was still pushing through ROFRs late into the night on September 30th tells me this wasn’t casual—it was calculated. Whether that means we’ll see a pause in October or a new fiscal ROFR strategy emerge is anyone’s guess, but as always… we’ll be watching.


What is Right of First Refusal (ROFR)?

For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.

DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.
