DVC Exercises Right of First Refusal (ROFR)

Year-to-date (YTD), Disney has exercised their right of first refusal (ROFR) on 194 Disney Vacation Club (DVC) contract, and DVC Resale Market (DVCRM) has sold 4,418, resulting in a 4.4% buyback rate (Contracts Bought Back in 2025/Contracts Sold in 2025). The 2025 waiver rate is 95.6%.

Key ROFR Updates

If you were hoping November would continue the sleepy trend from October, think again—buyback activity bounced back a bit this month. We saw 22 contracts taken via ROFR, which isn’t a huge jump in volume, but a few things stood out to me that are worth unpacking.

First off, Old Key West is quietly creeping up the leaderboard with 9 contracts bought back in November. That brings its yearly total to 52, putting it neck-and-neck with Grand Floridian, which holds the top spot at 55 buybacks YTD. Not too shabby for a resort that often flies under the radar.

Now, I know what you’re thinking: What about Riviera? Yes, DVC exercised ROFR on two contracts this month, but honestly? The price per point on those was so low that it would’ve been more surprising if Disney didn’t buy them back. So, not much to say there beyond “well… duh.”

What did catch my eye this month wasn’t a resort, but a number—and it lives near the bottom of the blog. If you scroll down, you’ll notice that the average ROFR review timeframe dropped to just 17 days, essentially cutting the previous month’s turnaround time in half.

Why the sudden speed boost? I’ve got two theories:

  1. DVC might be trying to clear the pipeline ahead of their annual Contract Administration shutdown (Dec. 1st–17th), when back-end systems are updated and no closings happen. Speeding up ROFR reviews before that blackout makes a lot of sense.

  2. We may be seeing early signs of the newly announced $500 resale transfer fee at work. It’s possible that DVC added staffing or resources to accommodate the new policy. And while nobody loves paying more fees, if it translates to faster processing and quicker closings, that’s at least something to feel good about in the resale space.

Overall, we’re still looking at a 4.4% YTD buyback rate, which means the vast majority of resale buyers still won’t encounter ROFR. But as always, the more attractive the price, the more you’re tempting the ROFR Monster.


What is Right of First Refusal (ROFR)?

For those new to the concept, Right of First Refusal is the option Disney Vacation Club has to purchase any resale contract after a sales price has been agreed upon, and the contract has been executed. Each contract must be forwarded to DVC for review.

DVC typically takes no more than 30 days to review the contract. At their discretion, Disney may step in and purchase the property themselves at the terms agreed upon by the seller and original buyer. DVC then becomes the buyer, and the purchase is complete. Once DVC is the buyer there is not an opportunity to come back with a better offer in hopes of still purchasing the contract.
